A Fair Lineup?

How can anyone think that LHO received a fair lineup when you read this?

Whether you think LHO was guilty or not we should be able to agree that he did NOT receive a fair lineup as stating that he worked at the TSBD had to make him stand out as this is where the media was claiming the shots originated from.

We also have seen in my "Statements That Sink The WC's Conclusions"* that some people were asked to sign their statements regarding the lineups BEFORE they even viewed them!

We are not told about the bizarre nature of this police line up. [10] Four men stood in the line up, three well dressed police officials, detectives--W. E. Perry (7H232-235) and Richard Clark (7H235-239), and jail clerk Don Ables (7H239-243)--and then the rudely dressed Oswald. Each was asked to give their name and occupation. The first three gave fake answers. Oswald though gave his true name and said he worked in the Depository, which by then the world knew about, and his picture was in the papers Whaley read that morning.

Your focus on the "fairness" of the lineup discounts the ability of witnesses to say that he was not the guy or at least they wouldn't make an identification if they were not sure.  It's typical CTer nonsense to concern yourself completely with details like whether Oswald was asked to state his place of occupation and discount random, ordinary people could refuse to identify him if they were not sure.  Which some did.  Oswald was stone cold guilty.  So no lineup would be "fair" to him if by that you mean witnesses who recognized him shouldn't have identified him even if they were sure he was the person they saw.

Domingo Benavides, who was the closest witness to Tippit's murder, told the WC he got a very good look at the killer but wasn't brought in for a line up. His description of the killer doesn't match a photo of LHO taken while in DPD custody on 11/22/63.

Right, witnesses could exercise their discretion not to identify Oswald even if the lineup was not "fair."  They could have dressed Oswald as the Easter Bunny and if a witness had doubts he was the guy they saw they could say he wasn't the guy or they were not sure.  Brennan has explained his unwillingness to ID Oswald.  It wasn't because he could not ID him as the shooter.  But the relevant point here is that witnesses have the discretion to make the identification or not.

But the relevant point here is that witnesses have the discretion to make the identification or not.

That doesn't somehow turn an unfair lineup into a fair one.

Unfair lineup = invalid results
