The jury 'knows when he's cornered he lies': former prosecutor on Trump's damaging deposition



MSNBC host Ayman Mohyeldin showed some of the clips of Donald Trump's deposition in the E. Jean Carroll case and wondered how the jury might react in the trial based on what has been revealed from the tape.

"What do you make of that?" he asked former federal prosecutor Cynthia Alksne. "I mean, based on what you've seen from that day, those three clips we've played for you, the inability to recognize his ex-wife, the stupidity of the second comment about stars have been doing it for a million years, and then that bit where his defense is 'you're not my type,' and attacking the attorney there. Did Trump seemingly make the right decision not to take the stand?"

Alksne laughed: "Yes! That's for sure. But let's remember this when he takes the stand of that deposition; he's talking to the jury. And what we know from the first point, not only does he not identify Carroll, thinking she's Marla Maples, when he is confronted with that, and leaving aside his lawyers' improper coaching of him, when he is confronted with it."

The reference she is making is a moment in the deposition in which Trump is asked about a photo of E. Jean Carroll in which he mistakes her for his second wife.

"It's Marla," Trump says, pointing to the photo. "That's Marla, yeah. That's my wife."

They looked at who Trump was pointing to, and it was Carroll.

"The woman you just pointed to is E. Jean Carroll. And the woman on the right is your wife, Marla," Trump's lawyer coached off camera.

"And when he is cornered like a rat, what does he do?" Alksne continued. "What does he say? He lies. He says, 'Oh, it's blurry.' And here's why that's important: that's because the jury has the photograph. And they know when he is cornered, he lies. Because he lied to them, that's what the deposition is. It's him talking to the jury. And in this case, not only did he not have the guts to come talk to them, he didn't even have the guts to come sit in the courtroom. Instead, he sent a bully to cross-examine this woman. And on the one occasion he was talking to them and was cornered, he lied to them. And I think it's important, and my guess is, in closing, it is highlighted."

Legal analyst Lisa Rubin has sat in on the trial since the start. Speaking on the panel, she recalled, "You could hear a pin drop during that deposition" when it was shown in court.

"And he did not just lie about the photograph being blurry," Rubin explained. "And by the way, the jury has seen that photograph multiple times throughout the trial. I can even tell you what plaintiff's exhibit number it is: it's 1:12. But you could hear a pin drop because he didn't just lie about that. He lied about all sorts of things, big and small, including whether or not he cheated on his first wife, Ivana Trump, when he was seeing Marla Maples. He claimed not to know whether those relationships overlap. He was seen escorting Marla Maples as early as 1989. He wasn't divorced from Ivana Trump until 1992. He couldn't even give [Carroll lawyer] Robbie Kaplan, the lawyer, the dates he was married to Marla Maples. He just continued a pattern of mendacity all throughout that deposition, that the jury is really going to have to think about in confronting whether or not this is a person about whom E. Jean Carroll was telling the truth."

Trump isn't testifying in New York E. Jean Carroll case despite saying he would

From the very beginning of the trial, Donald Trump's lawyer Joe Tacopina made it clear that former President Donald Trump wouldn't testify before the jury in the E. Jean Carroll case. But on Thursday, Trump claimed he was leaving his trip early, claiming that it was because he needed to testify in his own defense in the case.

As it turns out, his emergency trip back to the U.S. wasn't related, according to Tacopina.

The New York Daily News revealed Sunday evening that despite his "vow" Trump wouldn't be speaking in the civil rape trial.

"Manhattan Federal Judge Lewis Kaplan gave Trump until 5 p.m. on Sunday to request the case be reopened so that he could testify," the report said. "The judge’s eleventh-hour courtesy came after learning Trump told reporters last week that he’d cut his golfing trip in Ireland short so he could come back and attend the trial, unbeknown to his lawyer."

When 5 p.m. EST came, nothing was updated on the docket site indicating the trial would be reopened, and Trump would be testifying.

Trump claimed he had to “go back and confront this woman," the Irish Examiner reported Thursday.

Trump has been "confronting" Carroll on his social media site, but thus far he hasn't confronted her in court or in person.

The Trump legal team didn't put up any witnesses. The only defense was through cross-examination during the petitioner's side of the case.

Closing statements will happen Monday and close the trial.

'Nobody talks like that!' Attorney stunned how Trump incriminated himself in Carroll deposition



Civil rights attorney Nancy Erika Smith was flabbergasted by former President Donald Trump's self-incriminating statements during his deposition in the civil rape trial brought by writer E. Jean Carroll.

Speaking to "CNN This Morning," she explained the implications of what Trump said — and why it matters.

"The former president, obviously, decided not to testify. It's E. Jean Carroll's battery and defamation trial against the former president," said anchor Phil Mattingly. "Says he won't testify, even after he's accused of raping the former magazine columnist and defaming her by denying that claim, but saying that she wasn't his type. We should note that the former president has denied all of the charges here. What stands out to you about what you've seen throughout the course of this trial so far?"

"What stands out is his deposition and his defense of the 'Access Hollywood' tape, where he says famous and powerful men can assault women with impunity," said Smith.

Smith was specifically referencing the moment — played on CNN as they spoke — in which Trump said, "well, if you look over the last million years, I guess that's been largely true. Not always, but largely true. Unfortunately or fortunately."

"Most notable is he says 'fortunately or unfortunately,'" said Smith. "It's actually possible in his mind that it's fortunate that powerful men can assault women with impunity. It's actually an incredible admission in front of a jury. Also, his deposition makes it impossible for him to testify. It's no surprise. He contradicts himself regularly. And he shows the two elements that, really, rapists have in common. Misogyny. 26 women are not his type, meaning they're not attractive enough to rape or assault. That's an incredibly sexist comment. And power and domination. You can see in the deposition repeatedly how he tries to control the deposition by abusing Miss Carroll's lawyer and saying, you're not my type either, and you're a disgrace."

"I've been a lawyer for 42 years," added Smith. "No one's ever talked to me — and i've taken depositions of powerful sexual assaulters — nobody talks like that. It's like an admission of the characteristics of a man who assaults women. In addition to admitting it on tape. And saying it might be fortunate that he can."

The judge has ordered Trump not to post about any of the evidence in the Manhattan criminal case against him. If Trump violates this order he’ll be held in contempt. Trump is entering the “find out” stage of his downfall.

We all know that Republicans are liars and will do anything to cheat and steal an election from the American people, but now they are using old photos from Trump's failed presidency to attack President Biden.

During the 4 disastrous years of Trump, we had a border crisis that he caused due to his ignorance and incompetence. Trump handed his border crisis to Joe Biden when he took over and now President Biden is tasked with trying to fix this mess he was given.

Right wing Republicans and the right wing media want to lie to you pretending the migrants at the border only happened when Biden took over. That is completely false. The migrant disaster was already going on during Donnie's 4 years of failure.   

Now right wingers are using old photos from 2018 during the Trump border crisis trying to pretend that it's happening now on Biden's watch. Well, they got busted using old photos from the 2018 Trump border disaster.

So pathetic, and these right wingers will do anything to lie about President Biden. That's a reason Faux News had to pay nearly 1 Billion dollars for their disinformation.

GOP Georgia chair: Trump's lawyers advised me to stand as fake elector



David Shafer, the chairman of the Georgia Republican Party, now claims that his plot to stand as a fake elector should not be criminally charged because he was acting on the advice of former President Donald Trump's legal team, reported CNN on Monday.

"Specifically, Shafer’s attorneys say their client was relying on 'repeated and detailed advice of legal counsel' when he organized a group of 'contingent' electors from Georgia and served as one himself, thus 'eliminating any possibility of criminal intent or liability,' according to a copy of the May 5 letter," reported Zachary Cohen and Sara Murray. "The letter, which was first reported by the Atlanta Journal-Constitution, comes as Willis and her team of prosecutors investigating efforts to overturn the 2020 election results in Georgia are planning to make an announcement on possible charges against Trump or his allies later this summer."

This comes after reporting last week that eight of the 16 fake electors have accepted immunity deals from Fulton County District Attorney Fani Willis.

"Shafer, who sources previously told CNN could be among those indicted when Willis makes her charging announcements, has come under scrutiny for his role in the effort to put forward alternate slates of electors to block the certification of the 2020 presidential vote," said the report. "In their letter to Willis’s office, Shafer’s lawyers say he was 'given very direct, detailed legal advice on the procedure he should follow, and he followed those instructions to the letter ... I believe that any fair-minded person, with possession of all the facts, would conclude that Mr. Shafer and the other presidential elector nominees acted lawfully and appropriately.'"

The Fulton County District Attorney's office has run a broad investigation of the plot to interfere in the certification of the 2020 election results in Georgia, which saw the state vote Democratic for president for the first time since the 1990s. Among the issues scrutinized in the probe is Trump's phone call with Secretary of State Brad Raffensperger demanding he "find" extra votes to declare him the winner.

Willis has said that a decision over who to charge, potentially including Trump himself, could come at some point this summer.

Maddow highlights the Nazi speakers welcomed to Trump Doral Miami event this week

MSNBC host Rachel Maddow began her Monday show with a list of pro-Nazi speakers that are being welcomed to the Trump Hotel in Miami for an event where a number of former White House officials will also be speaking.

A former national security adviser, a former U.S. trade chief, a former Pentagon chief of staff and a former acting attorney general are all appearing at the same confab with those who have promoted Nazi ideology — and in some cases — Hitler himself.

"This week all of those people I just mentioned, literally, the guy who was the attorney general of the United States and the chief of staff and the national security adviser and the White House trade chief, all the rest of these guys with these very high-up jobs, this week, all of them are speaking at the same event in Miami. An event at a hotel owned by the former president. It will include all those Trump administration officials as well as the former president's adult son, Eric, the blond one, his daughter-in-law, plus a lot of Trump administration folks."

But it's the neo-Nazis that will be joining the Trump acolytes that might be new faces to the rest of America.

Scott McKay is a guy who blamed "the Jews" for killing Abraham Lincoln and William McKinley will speak at the event with Trump administration officials. He'll be welcomed to the podium to speak before the former White House staffers.

Far-right commentator, Charlie Ward is another one joining the event. He is known for sharing actual videos of speeches by Hitler and proclaiming that Sept. 11 was a secret plot by "the Jews." He also believes the Earth is flat and that President Joe Biden and Supreme Court Justice Amy Coney Barrett are lizard people.

The event is part of Michael Flynn's new Christian nationalism cult.

The group's co-founder told a recent QAnon audience that he's excited to be embraced by Donald Trump's inner circle and family members like Eric and Lara Trump.

“It's exciting … that Trump's inner circle is now going, they're all reaching out to our tour, to the ReAwaken America tour, to Gen. Flynn, to myself, to Kash Patel. And they're all saying, hey, can we come to the tour?" Clark beamed according to Media Matters.

And of course Donnie and his cheerleaders are now screaming their usual "witch hunt" after Donnie was found liable by a jury of his peers. No matter what crime Donnie commits or is found guilty of, MAGA will always cry "witch hunt" pretending to be a victim of the "evil left". No, it's just that Donald Trump is a criminal and is finally being held accountable by the justice system.

The jury awarded her $5 million in damages for her battery and defamation claims.

Asked on their verdict sheet if Carroll, 79, had proven “by a preponderance of the evidence” that “Mr. Trump raped Ms. Carroll,” the nine-person jury checked the box that said “no.” Asked if Carroll had proven “by a preponderance of the evidence” that “Mr. Trump sexually abused Ms. Carroll,” the jury checked the box that said “yes.” Both allegations were elements of Carroll’s battery claim.

The six men and three women also found Trump had defamed her by calling her claims a “hoax” and “a con job.”

The jury deliberated for only about three hours before returning the verdict.

Carroll did not comment outside of court, but her attorney Roberta Kaplan said, "We are very happy."

The verdict marks the first time a former president has been found civilly liable for sexual misconduct.
