They don't want a bi- or non-partisan independent commission to examine what happened. They know they couldn't attack its findings as partisan motivated since they would be involved. There's no political benefit for them in this type of investigation, an investigation which would clearly cause problems for them inside and outside the Party. The media would ask Republicans about the findings, they would be on the defensive and Trump would be going berserk complaining about the investigation and they would have to defend him or abandon him and incur the wrath of the Trumpists. So they want to let the House and Senate conduct the investigations - and the DOJ - so they can play the victim card. It may be smart politically but this is putting party over country to the extreme. Disgraceful.

McConnell said this after the attack/riot: "Former President Trump's actions preceding the riot were a disgraceful dereliction of duty... There is no question that President Trump is practically and morally responsible for provoking the events of that day. The people who stormed this building believed they were acting on the wishes and instructions of their president. And their having that belief was a foreseeable consequence of the growing crescendo of false statements, conspiracy theories, and reckless hyperbole which the defeated president kept shouting into the largest megaphone on planet Earth. The issue is not only the president's intemperate language on January 6th….It was also the entire manufactured atmosphere of looming catastrophe—the increasingly wild myths about a reverse landslide election that was being stolen in some secret coup by our now-president."

But we can't have a commission, no. Shameful.

One of the six Republicans in the Senate who voted for the commission, Ben Sasse, said this: “Nebraskans know where I stand on this: For the first time in our history, a mob targeted the Vice President and the Congress for following the Constitution by certifying the Electoral College vote. With Congress getting weaker and tribalism getting stronger, we’ve got to rebuild some public trust. Like others in the Nebraska delegation, I think that, if done right, a truly bipartisan commission could complement the work being done in the ongoing criminal investigations. The American people deserve a full account of what happened.”

Even that is too half hearted but at least it's something.

This would merely be fake impeachment 3.0.  Months of useless "investigation" that amounts to nothing.  Hundreds of people have been investigated and arrested.  The FBI devoted more resources to this than any crime in modern history.  There is nothing more to be learned except perhaps who murdered the unarmed protestor.  It is simply a pretext to beat up on Trump for months.

You sure have a vivid imagination.  To think that Trump was responsible for the Jan 6 problems is about as far out in never-never land as someone can be.  You can not provide one single sentence of speech by Trump that could possibly lead anyone to think he was calling for lawlessness.  In fact, every comment he made prior to, and on that day was to try to make everyone remain calm and do all they could to promote law and order.  If someone were serious about assigning blame, I don't see how Pelosi can be overlooked.  There were several recommendations made to her about items that should be done and she did not approve any of them.  When the final answer is known (which it basically already is known) the truth will show that the election was a total fraud and nothing about it was legal in several states.  Every location that used a Dominion voting machine was totally under the control of those that favored the Dimocrats.  But, in this country, we are free to believe what we choose to.

Yes. And one or two Capitol police officers are killed each day by peaceful visitors. It was all pretty normal. They are only making a big deal of Officer Brian Sicknick death because it happened right after Trump made a speech.

Murdered an unarmed protester? I imagine that over half the Nazis who participated in Kristallnacht or the Night of Broken Glass were not carrying firearms and so could be described as “unarmed protesters”.

She was part of a mob that assaulted the Capitol of the United States. An assault that would kill on Police Officer, cause another major damage to their eye and several other officers seriously injured. Then assaulted the Chamber for the House of Representatives, with Congress members still inside, trying to escape. Only with the mob on the verge of breaking through was lethal force used. Just one shot, I believe, followed by no more shots from the police once this proved to be enough.

A black person can be shot by the police for holding a cell phone. But for a white person to be shot by the police, they have to assault the Capitol, assault the House Chamber, be on the verge of seizing some Congressmen before getting shot. They really have to empty the bucket.

No Capitol police officer was killed on Jan. 6.  Another debunked media story.  The only person killed was an unarmed protestor.  The details of that crime including the name of the officer who shot her in the head remain undisclosed.  The family of a military vet deserve some answers for her death.  Hopefully they will get them in a lawsuit since the answers are not forthcoming.

You are condoning the shooting of an unarmed military vet and cover up of the details and then comparing her to a Nazi?  Unreal.  You should be ashamed.  At worst, she was in the commission of trespass in a public building.  There is no evidence that she posed any threat to anyone at the time she was apparently randomly shot.  Or do you think every unarmed protestor should have been gunned down that day like they would do in the old Soviet Union?  In addition, no Capitol police officer was killed on that day by anyone.  That is a lie.

Republicans do not want an investigation for 2 simple reasons:

1. GOP elected officials in Congress were involved in the illegal coup and insurrection.

2. The GOP doesn't want an investigation because it's their own Qanon and far right violent extremist base that was involved in the illegal coup, insurrection, and murder of Capitol Police officers.

Basically they would be investigating themselves and they can't allow that to happen.

But these anti American seditious traitors pretend to be patriotic Americans waving the flag and "backing the blue".

The U.S. Supreme Court long ago recognized the government's right to stop demonstrations that present a "clear and present danger" of violence or another "immediate threat to public safety, peace, or order" (Cantwell v. Connecticut, 310 U.S. 296 (1940)).

I'm not sure what you are babbling about here.  Again, I've said repeatedly that anyone who committed a crime on Jan. 6 should have been arrested.  I can't make that any clearer.  Hundreds of people have been arrested mostly for minor crimes such as trespass and vandalism.  I take issue only with the killing of an unarmed woman and a secret investigation that has not provided the details of her death.  She was shot in the head while unarmed.  The fact that you and others don't like her politics is not a justification for her execution any more than George Floyd's lengthy criminal history justified his murder.  That doesn't seem particularly controversial unless you believe that political beliefs are grounds to execute unarmed American citizens.  Like something out of Communist China.

Wrong.  You are conflating enforcement of the law - which obviously the police can do by arresting people - with the authority to execute unarmed people simply because they are in the commission of a crime.  These are very different concepts.  The police can use lethal force only in very limited circumstances even when a crime is being committed.  The police cannot execute people who jaywalk or speed.  And then  say they did so because the person was in the commission of a crime.  How did that work out for the police officer who murdered George Floyd?

Again this has absolutely nothing to do with whether ANYONE who broke the law that day should have been arrested.  If there were crimes committed, then arrest those people.  If there were legitimate grounds to use lethal force, then let's hear them.  What is so controversial about that?  Why a secret investigation if it is an open and shut case?  Floyd is not an entirely different situation.  He was in the commission of several crimes at the time of his arrest (passing counterfeit money, public intoxication, resisting arrest).  An open investigation into the facts and trial confirmed that he was murdered by the police even if he was breaking the law at the time.  Exactly the same situation as these unarmed protestors.  Why not provide an open investigation for Babbitt?  Maybe the facts and evidence will demonstrate that her death was justified.  Or maybe they will show us that something we have been told to accept is not true like the story about a Capitol police officer being killed with a fire extinguisher.   All I'm suggesting is that we be given the facts.  This is still America and not Communist China where the government does whatever it pleases and then covers it up.

And it's come back up around January 6th. We have footage of Proud Boys instructing journalists to go read The Turner Diaries."

Among other things, Belew said a noose and makeshift gallows erected outside the Capitol during the insurrection was a possible reference the The Turner Diaries, which includes a story about "The Day of the Rope."

The New York Times first reported on links between The Turner Diaries and the Capitol insurrection in January, when Amazon removed the book from its site.

"A group of white supremacists attacks the Capitol in an effort to overthrow the U.S. government," the Times wrote, describing the book's plot. "Dozens are killed in the assault, including members of Congress and their staffers. But in the insurrectionists' view, the greater victory is symbolic."

The NYT called the book "one of the most influential texts among white nationalists and right-wing extremists," adding that in addition to the Oklahoma City bombing, it has inspired dozens of other acts of violence over the years, and serves as a blueprint for how to enact an insurrection.

In Chicago, after Police Superintendent David Brown raised concerns before the "most challenging weekend of the year" for police, 100 people were shot and 18 people were killed from 6 p.m. Friday to 11:59 p.m. Monday, according to the Chicago Police Department. There were 69 shooting incidents during that period, police said.
There were the same amount of murders last year, but the number of shooting incidents and victims increased, according to data from Kellie Bartoli with the Chicago Police Department. There were 83 shooting victims and 18 murders in 47 shooting incidents from July 2-5, 2020, she told CNN in an email.
One of the 14 people killed was a member of the Illinois Army National Guard, CNN affiliate WLS reported. His family identified him on social media as Chrys Carvajal, though the Cook County medical examiner has not officially released his name.

Rep. Adam Kinzinger, R-Ill., one of the few Republicans to vehemently deny Donald Trump's claims of widespread election fraud, said that he suspects some of his Republican colleagues could have predicted the Capitol riot and even supported it.

"I won't name names, but yes, I do have that suspicion," Kinzinger told the New York Times Magazine in an interview. "I will say, if you just looked at Twitter — the whole reason I brought my gun and kept my staff home and told my wife to stay in the apartment was looking at Twitter. I saw the threats."

Kinzinger specifically called out a Jan. 6 tweet posted by Rep. Lauren Boebert, R-Colo., just prior to Trump's rally: "Today is 1776." Critics have speculated that Boebert was either aware of the rioters' plans to breach the U.S. Capitol building and/or calling for violent civilian protest.

"I don't know what that meant other than this is the time for revolution," Kinzinger said. "Maybe it was a dumb tweet that she didn't mean. Fine. I'll give her that credit for now. But if you have members of Congress who were involved in nurturing an insurrection, heck yeah we need to know."

During the insurrection, Boebert also publicized the exact location of House Speaker Nancy Pelosi, D-Calif. Rep. Eric Swalwell, D-Calif., later claimed that Boebert "was told by the Sergeant of Arms in the chamber to not make any social media posts. It was said repeatedly. She defied it because she is more closely aligned with the terrorists than the patriots."

Late last month, Pelosi moved forward with her plan to assemble a select committee to investigate the Capitol riot after facing opposition from Senate GOP members. Minority Leader Mitch McConnell, R-Ky., called the idea "purely" a "political exercise."

Kinzinger is just one of ten House Republicans who voted back in January to impeach the former president for inciting the violent insurrection that unfolded on the Capitol earlier this year. But perhaps with the exception of Rep. Liz Cheney, R-Wyo. – who was ousted from her leadership position in May over her apparent lack fealty to Trump – Kinzinger has been the most outspoken in his condemnation of the former president's election fraud conspiracies.

In the Times Magazine interview, Kinzinger said he believes that "the vast majority" of Republicans "agree with my position; they just aren't speaking out."

"If you're scared to tell the truth to people, I understand, but you need to find a different line of work," he argued. "On something as existential as this, as threatening to the Constitution — my goodness."

Earlier this year, Kinzinger launched his Country First PAC, a never-Trump political action committee that set out to reform the Republican Party, which he described as being "in the middle of this slow sink," much like the Titanic.

"We have a band playing on the deck telling everybody it's fine," he said. "And meanwhile, as I've said, you know, Donald Trump's running around trying to find women's clothing and get on the first lifeboat."

Though Kinzinger has expressed opposition to Trump, he has in the past politicked along staunchly conservative lines, voting to repeal the Affordable Care Act and repeal the Dodd–Frank Act. He also voted against the Equality Act and supports punishing sanctuary cities.

A new body cam video released Friday shows Jan. 6 insurrectionists brutally assaulting Metropolitan Police Department officers who had set up a perimeter around the Capitol, before dragging them down a staircase into a mob of angry protesters.

One of the insurrectionists involved, Jack Whitton, allegedly told an officer, "You're going to die tonight," and later boasted in a text message that he had "fed him (an officer) to the people."

"Idk (I don't know) his status," Whitton wrote in the text message to a friend, referring to the officer. "And (I) don't care tbh (to be honest)."

According to court documents, the attack left one of the officers with head wounds that required staples to close. This was after rioters "ripped off his helmet, maced him, took his gas mask and MPD-issued cell phone, kicked him, struck him with poles, and stomped on him."

Whitton, a CrossFit instructor from Georgia who allegedly beat one of the officers with a metal crutch, was denied bond in April after a judge said he represents "a serious danger."

Another one of the defendants involved, Jeffrey Sabol of Colorado, also remains jailed after planning to flee to Switzerland and attempting suicide in the wake of the insurrection.

Republicans are going to great lengths to whitewash history as part of their efforts to seize further power, conservative Washington Post columnist Max Boot wrote on Thursday.

A federal judge on Thursday lost patience with an accused Capitol rioter who expressed "no regrets" about his involvement in the Jan. 6 insurrection.

Brandon Fellows, a former grocery store worker from Schenectady, New York, was ordered back to jail while awaiting trial after a federal judge ruled he had violated the terms of his pretrial release by calling his probation officer's mother.

Judge Trevor McFadden says Capitol defendant Brandon Fellows has shown “sustained contempt for the government.”

Pretrial release is revoked. He’ll be locked up.

“I can no longer give the defendant the benefit of the doubt,” he said. “I’ve tried, but we are where we are.”

Prosecutors said the 27-year-old Donald Trump supporter skipped a court-ordered mental health evaluation and then called and spoke to his supervising probation officer's mother, and he was arrested again for violating court orders.

Fellows, who traveled to Washington, D.C., to hear Trump speak and wound up inside the Capitol, where he smoked a joint with his feet propped on the desk of Sen. Jeff Merkley (D-OR) and heckled police officers while roaming the halls.

"I have no regrets," Fellows said shortly after the riot. "I didn't hurt anyone, I didn't break anything. I did trespass though, I guess."

He later amended his boast to say he did have one regret.

"I do regret potentially smoking what may have been weed," he said in February. "I think that discredits me and makes me look stupid to a lot of people, and also it's not something I want to be sharing with my future children."

Prosecutors asked Fellows to plead guilty to felony obstruction of Congress, which carries a 15- to 21-month prison term, but defense attorneys say the government insists on asking the sentencing judge for a terrorism enhancement.

"I've definitely been annoying and I see the frustration from you and all of the parties," Fellows said. "I wouldn't want to deal with me if I was on the opposing side."

More than six months after the storming of the US Capitol, more than 550 people have been arrested, with an estimated 800 people surging into the building during the hours-long assault. Members of the Oath Keepers, a loosely organized right-wing paramilitary, and Proud Boys street fighters galvanized by then-President Trump's call to "stand back and stand by" have been indicted on conspiracy to disrupt Congress, which delayed the certification of Joe Biden as president by almost six hours.

"Every single person charged, at the very least, contributed to the inability of Congress to carry out the certification of our presidential election," prosecutors wrote in memorandum filed with the court on Tuesday.

The slow-moving tedium of prosecutorial legal machinery and the GOP campaign to deflect responsibility can make it easy to lose sight of the big picture of what transpired on Jan. 6. But based on an aggregate review of individuals cases, along with other sources, a Raw Story analysis of the critical events in the Jan. 6 siege reveals a striking degree of coordination, sustained and intentional violence, planning and preparation, and determined effort to disable the United States' critical governance apparatus by participants, including many with recent military experience. Many of the rioters who played critical roles in breaching the Capitol came away from the experience vowing to wage war against the United States. Few among those who are being prosecuted have expressed any remorse for their actions.

Amid the hundreds of prosecutions of Trump supporters motivated by the big lie, the GOP has punished lawmakers who fail to bear allegiance to the former president and run afoul of the party line that the election was stolen, while thwarting the House investigation into the events of Jan. 6. GOP intransigence makes it likely that the Democratic-led investigation will become reduced to another partisan snipe-fest, undermining its potential to hold people accountable and prevent future attempts to overturn democracy.

A handful of defendants, including Oath Keepers members, have pleaded guilty, as fresh arrests fatten the docket weekly. Those recently charged are not minor players: In addition to people who trashed media equipment and assaulted reporters, they include the first boogaloo-identified rioter, with hints that there are more to come, and a man who organized a resistance cell under the cover of a Bible study. Critically, the FBI has yet to make an arrest for bombs that were planted outside the Democratic and Republican headquarters on the eve of the insurrection. Even under the most optimistic scenario, the prosecutions are likely to drag on for years: Among the few cases set for trial, white nationalist Christian Secor isn't scheduled to begin deliberations until January 2022.

Beyond the chaotic events that took place when hundreds of Trump supporters unleashed mayhem on the Capitol, it remains unknown to what degree, if any, the Proud Boys and the Oath Keepers coordinated their actions. And beyond Trump's feverish promotion of the Jan. 6 "Save America" rally and instruction to his followers to "walk down to the Capitol," it also remains to be seen whether the siege may have been directed by the president or his surrogates through intermediaries such as Trump confidant Roger Stone or "Stop the Steal" organizer Ali Alexander.

Notably, the mob began its advance on the Capitol well before Trump had finished speaking at the Ellipse, suggesting that key players had decided in advance to disrupt the certification of the electoral vote, while Trump's exhortations mobilized thousands more to reinforce the riot that was already unfolding at the seat of American government.

On Jan. 5 at 8:28 p.m., some 60 Proud Boys on an encrypted channel named "Boots on the Ground" received instructions from an as-yet-unnamed individual, according to government court documents. "Everyone needs to meet at the Washington Monument at 10 a.m. tomorrow morning!" the message read. "Do not be late! Do not wear colors! Details will be laid out at the pre-meeting. Come out as a patriot!"

Marching towards the Capitol on the morning of Jan. 6, Proud Boys — an anti-democratic group that cloaks its white supremacy under a soft cover of "Western chauvinism" — chanted, "Where's antifa?" Many carried Baofeng walkie-talkies and wore earpieces. The Proud Boys had previously clashed with antifascists adversaries in the streets of Washington DC during pro-Trump rallies on Nov. 14 and Dec. 12, but on Jan. 6 they didn't find any leftists to fight.

Proud Boys' de-facto leader on Jan 6 is raising money 'to make ends meet':

Then referring to the arrest of Proud Boys Chairman Enrique Tarrio two days earlier and the stabbing of four members on Dec. 12, Nordean seemed to address the police: "You took our boy in, and you let the stabber go. Video livestreamed by California Proud Boy Eddie Block shows that the group had made it to the west side of the Capitol by around 11:20 a.m. Trump had tweeted the day before that he would be speaking at the Ellipse at 11 a.m. Had he started on time, the Proud Boys would have been in place in front of the Capitol while he was speaking. But Trump did not start speaking until noon, leaving the Proud Boys time to kill.

Proud Boy Dan 'Milkshake' Scott arrested after assaulting police at Capitol

At around 11:47 a.m., the Proud Boys stopped on the east side of the Capitol and milled around. While lining up for a group photo, Proud Boy Dan Scott aka Milkshake yelled, "Let's take the f***ing Capitol." An unidentified individual admonished him: "Let's not f***ing yell that, all right?"

About five minutes after the photo op, Block's livestream shows that the group started moving north towards Constitution Avenue. The Proud Boys took a break next to a row of food trucks outside of the Department of Labor for roughly 35 minutes.

While the Proud Boys were eating and resting, Trump was addressing his supporters a mile and a half away at the Ellipse.

"We're going to walk down to the Capitol, and we're going to cheer on our brave senators, and congressmen and women," he said. "We're probably not going to be cheering so much for some of them because you'll never take back our country with weakness. You have to show strength, and you have to be strong."

Christopher Quaglin, an unemployed electrician from New Jersey, livestreamed himself walking to towards the Capitol.

"Trump is speaking and everyone is walking there," Quaglin said. "And I am walking there." He turned his camera to show the Capitol.

"And I am ready," Quaglin said, holding up a gas mask for viewers to see. "We will see how it goes. Proud of your boy."

At about 12:43 p.m., Ethan Nordean announced to the Proud Boys gathered beside the food trucks that they would be heading to the "roundabout," likely referring to Peace Circle, which aligns with the northwest approach to the Capitol.

Charles Donohoe, later described by a magistrate judge as a "trusted senior lieutenant" who was responsible for ensuring the group's secure communications," walked some distance ahead. A Marine Corps veteran, Donohoe served as president of the North Carolina Piedmont chapter of the Proud Boys. Nordean led the march, along with Joe Biggs, an Army veteran described by his lawyer in a legal filing as "a mainstay Proud Boy planner and organizer since 2018," and Zach Rehl, president of the Philadelphia chapter. The group paused for a moment on First Street, and Billy Chrestman, from the Kansas City chapter, conferred briefly with Nordean.

Proud Boy pal brags about role in Capitol attack

Around 12:45 p.m., as Trump was still speaking, the Proud Boys converged with a large crowd at Peace Circle, according to court documents. Along with Nordean, Biggs, Donohoe, Rehl, Block and Chrestman, the group included Proud Boys Dominic Pezzola, Matthew Greene and William Pepe. Pezzola, a Marine Corps veteran from Rochester, and Greene, an Army National Guard veteran with combat experience in Afghanistan, had traveled to DC together from Syracuse. Pepe, who was employed by the New York City Metropolitan Transportation Authority, had worked until midnight on Jan. 5, and spontaneously decided to drive through the night, according to a filing by his lawyer. Pepe had met Pezzola for the first time at a protest on Dec. 5, according to a filing on Pepe's behalf.

'Extensive history of violent and assaultive behavior'

While the Proud Boys and other Trump supporters massed at Peace Circle, Ryan Samsel of Bucks County, Pa. walked over to chat with Biggs, video from a recent New York Times visual investigation shows. It's not clear what they discussed. Federal investigators would later discover what government lawyers describe as "an extensive history of violent and assaultive behavior and of intimidation of witnesses" on Samsel's part. In opposing pre-trial release for Samsel, a government lawyer would write that the Samsel's history showed a pattern of "choking and beating women to the point of loss of consciousness, of many hospital visits for many victims, of chipped and missing teeth, and of Samsel even breaking into a victim's home multiple times to assault her."

Pennsylvania Capitol rioter who attacked cop has a history of violence against women accusations

Biggs' lawyer, J. Daniel Hull, told Raw Story his client didn't know Samsel. "Joe doesn't know him," he said. "Never heard that name."

About a minute after speaking with Biggs, Samsel walked toward the barricades. As the first person to confront US Capitol police officers blocking the path, Samsel was in effect the spearpoint of the initial attack on the Capitol. According to a statement of facts supporting Samsel's charges, he and others pushed and pulled on the barricades, a series of metal bike racks reinforced with plastic mesh netting. In the process of throwing the barricades to the ground, they reportedly knocked over a police officer, causing her to hit her head on the stairs behind her, causing her to lose consciousness.

"We don't have to hurt you, why are you standing in our way?" Samsel reportedly said, while picking her up off the ground. The officer, referenced in court documents as "O-1," was directed to go back to the West Terrace at the Capitol to regroup. Hours later, according to the government, she would black out and collapse while arresting another rioter and had to be transported to a local hospital, where she was diagnosed with a concussion.

After Samsel dismantled the first set of barriers, Proud Boys and other rioters streamed down the walkway. At the second set of barriers, Pepe and another rioter grabbed one of the bike racks and dragged it aside to allow the crowd to advance to a police line guarding the plaza on the west side of the Capitol, according to a government filing. (In a legal filing on Pepe's behalf, his lawyer described the scene differently: "People ahead of him threw barricades in his direction forcing him to push them out of the way to avoid being hit by them.")

Pezzola was one the first reach the next police line, which was quickly overwhelmed by the crowd, according to the government. As rioters were pouring onto the plaza on the western side of the Capitol, Congress began the tally of electoral votes and Vice President Mike Pence released a letter declaring he did not have unilateral authority to overturn the results. Trump concluded his speech at the Ellipse at 1:11 p.m., reinforcing his call to action.

"So, we're going to, we're going to walk down Pennsylvania Avenue," Trump said. "We're going to give our Republicans, the weak ones, because the strong ones don't need any of our help, we're going to try and give them the kind of pride and boldness that they need to take back our country."

As scuffles broke at the Lower West Terrace in front of the Capitol, Pezzola wrested a riot shield away from a US Capitol police officer. During the melee, the government alleges that Donohoe helped Pezzola carry the shield, and that Donohoe reported in a group message to fellow Proud Boys on Telegram: "Got a riot shield."

'Lords of war'

By the time of the Capitol insurrection, Pezzola had become a celebrated figure in the Proud Boys, earning the praise of Chairman Enrique Tarrio for a news photo that showed him striking a menacing pose at the front of a line of Proud Boys in DC on Dec. 12. Tarrio shared the photo on Parler on Dec. 31, writing, "Lords of War. #J6 #J12."

Other Proud Boys were also in the thick of the action. Billy Chrestman can be seen in video published by the New York Times rallying the mob with his back to the police line, shouting, "Whose House is it?... Do you want your House back?... Take it!" Around the same time, the government alleges that Christopher Worrell, a Proud Boy from Naples, Fla., sprayed pepper gel at police. The New York Times footage also shows rioters throwing bike racks.

Around 1:35 p.m., some in the crowd turned their focus from the plaza to a set of steps encased by scaffolding that had been set up for the inauguration. Worrell and Dan Scott aka Milkshake were positioned in the front line of that fight with officers at the lightly guarded entrance to the staircase. Footage shows the heavyset Scott heave his body against the police line and then briefly fall back, and others take advantage of an officer lunging at Scott to break through the line. The decision to take the staircase is described by the Times as a "pivotal move," noting that it provided "direct access to an upper level — and dozens of doors and windows."

Among the first to ascend the stairs were Pezzola and Greene, the Proud Boys from central New York, along with Robert Gieswein, a Colorado Three Percenter dressed in full tactical gear and carrying a baseball bat who had marched with the Proud Boys.

While one group moved up the staircase, more rioters poured onto the Lower West Terrace. Less than 10 minutes after the staircase entrance was overrun, Jonathan Pollock, Olivia Pollock, Joseph Hutchinson, Joshua Doolin and Michael Perkins — all from Florida — moved into the plaza. Jonathan Pollock and an unknown person charged the police line with flagpoles, according to the government. Hutchison and another person grabbed a fence and pulled it away, allowing rioters to surge into the police line. Pollock reportedly jumped over other rioters to attack the police, grabbing an officer and pulling them down a short set of steps. After going down in a pile, Pollock is accused of punching two police officers and choking a third.

One rioter accused of sustained and continuous assaults on police is Christopher Quaglin, who reportedly accosted Metropolitan police officers on the Lower West Terrace at 1:36 p.m., yelling, "You don't want this fight. You do not want this f***ing fight. You are on the wrong side. You're going to bring a f***ing pistol, I'm going to bring f***ing cannon."

More than 30 minutes later, still battling police on the Lower West Terrace Plaza, Quaglin is accused of shoving an officer. A government motion in Quaglin's case indicates that Quaglin was seen interacting with Proud Boys leader Ethan Nordean, and prosecutors also say Nordean grabbed Quaglin by the shoulder to stop him after he pushed the officer.

In a motion filed on behalf of Nordean, his lawyer wrote, "Nordean notes that he does not know — or have any relationship with — Quaglin."

Quaglin at one time claimed to be a member of the Proud Boys, according to evidence presented by the government. In a Nov. 3 social media post, Quaglin reportedly posted a photo of the Proud Boys, writing, "Proud to be one." But in social media chats from Nov. 6 that were retrieved by investigators, Quaglin indicated he was organizing a group of his own. "I have been beginning a group for 2 years," he wrote. "Proud boys don't even know about it."

Court documents also indicate Quaglin told an acquaintance that he was considering joining the Proud Boys and had met with members of the organization in New York.

Regardless of whether he was a member of the Proud Boys or not, he was familiar enough with the group to post on social media on Dec. 26 about his plans for Jan. 6: "Bigger the group the better. And we aren't repping any proud boy colors Fyi. Keeping it as invisible as we can."

That was three days before Chairman Enrique Tarrio posted on Parler: "The Proud Boys will turn out in record numbers on Jan 6th but this time with a twist." He continued: "We will not be wearing our traditional Black and Yellow. We will be incognito and we will spread across downtown DC in smaller teams."

'Patriots storming the Capitol building'

At 2:13 p.m., while members of the House and Senate deliberated in their respective chambers over an objection filed by Rep. Paul Gosar (R-Ariz.), Proud Boy Dominic Pezzola used the stolen riot shield to smash out a window accessed from the West Terrace.

Michael Sparks of Kentucky was the first rioter to enter the Capitol through breached window, according to the Times investigation. The first group through window included Pezzola; Robert Gieswein, the Three Percenter wielding a baseball bat; QAnon follower Doug Jensen; Kevin Seefried, carrying a Confederate flag; and his son, Hunter Seefried.

FBI flooded with over 230,000 tips as they hunt hundreds more

Almost immediately, an unidentified man wearing a helmet kicked open the adjacent doors, allowing more rioters to enter the Capitol. Joe Biggs, the Proud Boys planner and organizer, walked through the doors about two minutes later. In the first five minutes, Zachary Alam, a laid-off hotel concierge from Washington DC, also entered the building through the compromised doors.

The Oath Keepers, a competing far-right group, mobilized slowly, relative to the Proud Boys.

Around the same time that Pezzola breached the Capitol on the west side, the Oath Keepers' designated "ground leader" for Jan. 6 — a man known as "Whip" — wrote in the group's Leadership Signal chat: "The [sic] have taken ground at the capital[.] We need to regoup any members who are not on mission."

Roughly 20 minutes later, according to the government, Oath Keepers Roberto Minuta, Joshua James and Jonathan Walden would race towards the Capitol in golf carts, swerving around police vehicles, after Minuta and James provided a personal security detail to Trump confidant Roger Stone.

"Patriots are storming the Capitol building; there's violence against patriots by the DC police, so we're en route in a grand theft auto golf cart to the Capitol building right now," Minuta reportedly yelled. "It's going down, guys; it's literally going down right now. Patriots storming the Capitol building…. F***ing war in the streets right now…. Word is they got in the building…. Let's go."

There is some evidence of communication between the Oath Keepers and Proud Boys related to Jan. 6. Kelly Meggs, who would be named Florida "state lead" for the Oath Keepers, mentioned an alliance to an acquaintance in a Dec. 19 Facebook message sent the day after the second pro-Trump rally in DC.

"Well, we are ready for the rioters," Meggs wrote. "This week I organized an alliance between Oath Keepers, Florida 3%ers and Proud Boys. We have decided to work together to shut this spombleprofglidnoctobuns down."

Beyond his reference to "rioters," the timing of Meggs' statement — one day after right-wing Trump supporters clashed with leftist adversaries — strongly suggests that the target of Meggs' proposed alliance was antifascist counter-protesters, not the US government or law enforcement.

"Plus, we have made contact with PB and they always have a big group," Meggs wrote in a Facebook message a couple days later. "Force multiplier."

Then, he added: "I figure we could splinter off the main group of PB and come up behind them. F***ing crush them for good."

Oath Keepers founder Stewart Rhodes and Proud Boys Chairman Enrique Tarrio met briefly in a DC hotel parking garage on the eve of the Capitol insurrection, but there's no evidence they discussed plans for the events of the following day. Footage from a Channel 4 documentary shows the two men introducing themselves to one another. "I don't consider him an enemy; I didn't consider him an enemy before — we just had our differences," Tarrio later told the interviewer. "We don't normally work with other groups. That's just not…."

While the Oath Keepers were scrambling to get in place on the east side of the Capitol, rioters were streaming into the building from the west side thanks to the entry breached by Pezzola. According to the New York Times, it took only two minutes for rioters to make it from the breach to the Senate doors. As the Times investigation details, Officer Eugene Goodman rushed downstairs as the Senate was being evacuated and intercepted the rioters.

"Where are they counting the votes?" a rioter can be heard shouting at Goodman. The Times footage shows lawmakers fleeing behind the rioters, with only one officer standing guard.

Goodman ran up the stairs, pursued by QAnon follower Doug Jensen, luring them into a hallway where backup officers were waiting. In addition to Jensen, the mob at that point included Robert Gieswein; Kevin Siefried; brothers Jerod and Joshua Hughes from Montana; and Jacob Chansley, the so-called "QAnon Shaman."

"He believed he was preventing the certification of President Biden," Judge Timothy J. Kelly said during Jensen's detention hearing on Tuesday. "He thought he was taking part in actions that would result in arrest of members of Congress and Vice President Pence."

Before ordering Jensen's release, Kelly observed that Jensen "recognizes he bought into a pack of lies." While noting that Jensen's expressions of remorse might have an element of convenience considering that he's facing serious criminal charges, Kelly said "they do distinguish Mr. Jensen from many other defendants."

[B]A Marine leads the charge through the Columbus Doors[/b]

About 10 minutes after Proud Boy Dominic Pezzola breached the Capitol from the West Terrace, a mob was massed outside the Columbus Doors, which provide access to the Rotunda from the east side. Three rioters who had entered the Capitol from elsewhere were trying to push the doors open while US Capitol Police officers battled the mob outside, according to a government filing.

Christopher Warnagiris, an active-duty Marine Corps officer stationed at Quantico, was the first to push through the Columbus Doors, according to prosecutors, at 2:25 p.m. At that moment, Oath Keepers leader Stewart Rhodes summoned his members to the southeast side of the Capitol.

Only a minute earlier, Trump had sent a tweet condemning Vice President Mike Pence, whom his supporters now regarded as a traitor.

Once inside the Capitol building, Warnagiris positioned his body near the entrance to keep the door open and reached for other rioters to pull them inside. Charging documents also indicate that Warnagiris struggled with an officer attempting to regain control of the entrance.

As the trickle through the Columbus Doors became a raging stream of euphoric rioters, about 10 Oath Keepers dressed in tactical gear snaked up the outside steps in the "stack" formation with hands on each other's shoulders. Kenneth Harrelson and Jason Dolan, two military veterans from Florida, were already at the top of the steps by then. At about 2:39 p.m., according to the government, the Oath Keepers entered the Capitol building.

Once in the Rotunda, Oath Keepers Jessica Watkins, Donovan Crowl, Sandra Parker, Graydon Young, Laura Steele and William Isaacs headed down a hallway towards the Senate, as rioters chanted "F*** McConnell," but police pushed them back into the Rotunda by deploying chemical irritant, according to the government. With the access to the Senate blocked, Oath Keepers Kelly Meggs, Connie Meggs, Kenneth Harrelson, Jason Dolan and Joseph Hackett started walking southbound towards the House of Representatives.

"He apparently was searching for at least one member of Congress in particular — House Speaker Nancy Pelosi," Judge Amit Mehta reflected in an order to keep Kelly Meggs in pre-trial detention. Mehta cited an exchange on Signal in which an unidentified acquaintance told Meggs on the evening of Jan. 6 that he "was hoping to see Nancy's head rolling down the front steps."

"We looked forward her," Meggs reportedly responded. (Mehta surmised that "forward" was likely a typo and that Meggs actually intended to say, "We looked for her.")

'Break it down!'

Zachary Alam, who had entered the Capitol through the window breached by Proud Boy Dominic Pezzola roamed the building for roughly 40 minutes, eventually joining a mob that formed outside the doors to the Speaker's Lobby, adjacent to the House chamber. Thomas Baranyi of New Jersey, Phillip Bromley of Alabama, and Ashli Babbitt, an Air Force veteran and QAnon supporter from San Diego, Calif. also joined the mob. The scene was captured by John Sullivan, a veteran of the previous summer's police accountability protests with a dubious reputation among Black Lives Matter activists. In addition to documenting the events, Sullivan repeatedly encouraged and celebrated the mayhem, and can be heard in his video addressing one of the officers guarding the doors to the Speaker's Lobby by saying, "We want you to go home. I'm recording and there's so many people and they're going to push their way up here. Bro, I've seen people out there get hurt. I don't want to see you get hurt."

As described in an affidavit supporting charges, Alam repeatedly punched the glass panels of the doors, causing the glass to shatter, and then pushed his body against Capitol police officers guarding the door. The Capitol police officers moved aside, as officers in riot gear appeared behind the crowd of rioters. The changeover resulted in a critical gap that allowed Alam and the other rioters to escalate. After the first set of officers withdrew, according to the government, Alam took a helmet from another rioter and struck the middle panel, further shattering it, as others chanted, "Break it down!" and "Let's f***ing go." Babbitt hoisted her body through one of the windows broken out by Alam, and with a single discharge a Capitol police officer on the other side fatally shot her in her front left shoulder. Babbitt fell backwards, instantly becoming a martyr to MAGA loyalists, Proud Boys and an even more extreme faction of white nationalists who advocate for racial separation.

Only three minutes before Babbitt's shooting at 3 p.m., the Washington Post has reported, lawmakers, including Rep. James McGovern (D-Mass.) were being evacuated through the Speaker's Lobby.

The government has singled out Alam among the rioters surrounding Babbitt for his "unhinged, violent actions at the front of that volatile mob."

Battle of the Lower West Terrace tunnel

While rioters poured into the Capitol building from both ends, others continued to engage US Capitol police, Metropolitan police and other agencies in a furious battle on the Lower West Terrace, tying up law enforcement resources and resulting in countless injuries. Officers fought to hold their position and deny entry through the prominent entrance leading into the Capitol through a short tunnel and series of glass doorways.

Among those who joined the battle was Thomas Webster, a retired New York City police officer who had previously worked the security detail for City Hall and Gracie Mansion. Webster is accused of choking a police officer, causing him to lose consciousness and to not be able to breathe for 10 minutes.

By 2:40 p.m., according to a government filing in the prosecution of Pennsylvania resident Robert Morss, rioters had "engulfed" the west side of the Capitol and were "climbing on the scaffolding in front of the build as well as various features of the building."

In phone texts with a friend two days earlier, Morss, a Penn State University graduate and Army Ranger veteran with three combat tours in Afghanistan, had written: "Just bring food water and medical spombleprofglidnoctobuns and we'll be fine!" To another friend on the same day, Morss had texted: "I'll have my plate carrier on as well." He added, "I'm ready for anything and everything brotha."

The scene at the tunnel on Jan. 6 is described in boilerplate language used by prosecutors in court filings for multiple defendants: "Officers reporting to the scene rushed to the tunnel from within the building while rioters outside of the tunnel continued to summon more men to push their way through the tunnel with a variety of tools and weapons. The tunnel became the point of an intense and prolonged clash between rioters and law enforcement at the United States Capitol."

The rioters displayed remarkable coordination, with Morss taking a prominent role. As described in affidavit supporting charges, a YouTube video shows Morss and other rioters rip a riot shield away from a Metropolitan police officer. Morss or another rioter — it's not clear from the video — yelled, "Send the shield back, send the shield back!" Minutes later, Morss reportedly carried the shield away and passed it to the rioters behind him, who in in turn passed further back into the crowd.

Morrs then walked out of the tunnel and into the crowd near the arched entrance and yelled to the other rioters: "Shield wall!"

"Rioters inside the tunnel use police riot shields and police riot batons to combat uniformed law enforcement officers," an FBI special agent wrote in an affidavit supporting charges against Christopher Quaglin, the unemployed electrician who had been restrained by Proud Boys leader Ethan Nordean earlier in the day. "Rioters can be overheard planning and implementing a rotation of rioters to have the 'fresh' rioters up front to combat law enforcement, with various unidentified individuals yelling 'we need fresh patriots in the front' and 'we need fresh people.' Rioters are heard instructing the front line of rioters to make a 'shield wall' to prevent law enforcement from controlling rioters with oleoresin capsicum spray. Multiple rioters then use the stolen shields to push against the line of officers as additional rioters add their weight and push, too."

One of the rioters heard yelling, "We need fresh people," was Federico Klein, then employed in the State Department as a political appointee under President Trump and a Marine Corps veteran.

Another YouTube video shows Quaglin using a stolen shield to push up against officers in the tunnel, according to the government, and then hitting a Metropolitan officer in the side of the neck and face with the shield. Quaglin had recently sprayed OC spray directly in the face of the same officer, who was not wearing a face shield or gas mask, according to the government.

The time and location of the alleged offenses committed by Quaglin are so closely aligned with other rioters that he was indicted for multiple counts of assault alongside three other men — Patrick E. McCaughey III of New York, Tristan Chandler Stevens of Florida, and David Lee Judd of Texas — although no evidence has been presented to indicate that any of the men knew each other before Jan. 6.

By around 3:20 p.m., police had pushed the rioters out of the tunnel, but the battle would yet continue for another two hours.

At 4:17 p.m., according to the government, Morss and other rioters climbed through a broken window into a hideaway office for members of Congress, which had been unoccupied at the time.

"Video posted online showed rioters handing out furniture from the room through the broken window at different times throughout the unrest," an affidavit supporting charges against Morss reads. "Similar furniture (including what appear to be legs of chairs/tables and desk drawers) was then used by other rioters to attack officers guarding the Lower West Terrace doors, as capture by surveillance and BWC footage."

Bring the war home

After the siege, many of the insurrectionists celebrated their accomplishment of delaying certification of the electoral vote for almost six hours. They scrubbed their social media accounts and concealed evidence in anticipation of criminal charges. And some appear to have prepared for a protracted guerrilla war.

In late June, the government filed a motion in support of Proud Boy Matthew Greene's continued detention, citing an interview conducted by the FBI with an unidentified witness who identified Greene as being among "a group of individuals" who described their actions on Jan. 6. "According to W-1, members of this group said that anyone they got their hands on they would have killed, including Nancy Pelosi. W-1 further stated that members of this group, which included Greene, said that they would have killed [Vice President] Mike Pence if given the chance."

In a Signal chat recovered from Greene's phone when agents raided his home on Jan. 18, Greene is alleged to have written, "'We had a f***ing rat in our ranks,' and encouraged the acquaintance to study guerilla warfare tactics based on their time in Afghanistan and to 'be prepared to do uncomfortable things' before sending multiple images that appear to reference the death of Ashli Babbitt, the rioter who was shot and killed inside the Capitol on January 6. He concluded, following those images, 'Don't forget what they did," before apparently attempting to make the message self-destruct in an hour."

Consistent with Greene's expression of support for continued resistance, fellow Proud Boy Charles Donohoe pushed back against another member who expressed the view that it would be "too late" once President Biden took office.

"No, it's not," Donohoe replied in a Telegram chat, according to the government. "It's never too late, ever.

Facial recognition doesn't mean spombleprofglidnoctobuns when you got a 5.56 green tip," he added, using a term that the government identified as "armor-piercing ammunition for assault rifles."

Zachary Alam was arrested on the run at a motel in eastern Pennsylvania on Jan. 30. The FBI agents who arrested him said his black Chevy truck bore a fictitious plate, and that a second plate stolen from a vehicle in DC more than two years earlier was stashed inside the vehicle. Agents also recovered a burner phone and a copy of Recoil OffGrid magazine, described by the government as catering to "an audience of people interested in living 'off the grid'" and providing "'practical' information about 'key topics you need to be resilient in the face of hardship,' including 'escape and evasion.'"

Similarly, when FBI agents raided Florida Oath Keeper Kenneth Harrelson's house in Titusville, Fla., they reportedly recovered a go-bag with a semi-automatic handgun, a burner phone and three books: The Book of Five Rings; The Bushcraft Field Guide to Trapping, Gathering and Cooking in the Wild; and Technological Slavery: The Collected Writing of Theodore J. Kaczynski aka 'The Unabomber.'

Robert Morss, who had coordinated the shield wall during the battle of the West Terrace tunnel, was arrested on June 11 outside his apartment in the Pittsburgh suburbs while he was leaving to go to his job as a substitute teacher at Shaler Area Middle School. During Morss' arrest, law enforcement recovered three firearms, a military utility bag, tourniquet and military fatigues. They also found a notebook in his car with a handwritten checklist headlined, "Step by Step to Create Hometown Militia." The writings "included a list of names, a list of equipment, and a list of steps, such as 'Battle Drills'; 'Ambush'; and 'Formations,'" according to the government.

Morss' lawyers attempted to downplay the notebook in a response filed on Monday seeking their client's release from detention as he awaits trial.

"Although the government's concern is understandable," the lawyers wrote, "Mr. Morss reports that he utilizes 'journaling' in part as an outlet to express his trauma from serving in combat duty."

A coalition of more than a dozen news organizations have sued to gain access to video evidence against accused U.S. Capitol rioters, and ProPublica has assembled dozens of exhibits that show the violent Jan. 6 assault.

The nonprofit news organization is among 15 media outlets, including the Associated Press, Washington Post, CBS and NBC, that have filed lawsuits seeking access to the exhibits, and ProPublica is posting all of them online as federal judges rule in their favor.

The videos are organized case by case under each defendant's name, and show Donald Trump supporters violently attacking law enforcement as they storm the Capitol to stop the certification of Joe Biden's electoral win.

ProPublica is adding new videos to the collection as federal courts and the Department of Justice sends them.

DOJ delivers a 'significant' blow to Trump as Capitol riot hearings open

Donald Trump's alleged efforts to get Justice Department officials to overturn the results of the 2020 election constitute an "extraordinary circumstance" and are not protected by executive privilege, the DOJ wrote in a letter this week.

In the letter obtained by the New York Times, the DOJ advised officials who served in the Trump administration that they can give "unrestricted testimony" to committees investigating the Jan. 6 insurrection, including the House panel that will meet for the first time Tuesday.

"The decision runs counter to the views of former President Donald J. Trump, who has argued that his decisions and deliberations are protected by executive privilege," the Times reported. "It also sets up a potential court battle if Mr. Trump sues in a bid to block any testimony.

Trump's supporters have argued that "executive privilege" applies to the former president's communications, but others say it's a matter of "settled law" that executive privilege doesn't apply to extraordinary circumstances. In this case, the Times notes, Trump "pressured DOJ officials overturn the results of the election, asking them to open investigations into claims of vote tampering that investigators said they had already looked into and determined to be untrue."

Bradley Weinsheimer, a top ranking career official in the deputy attorney general's office, noted in the letter that Trump was attempting to use the DOJ to advance his "personal political interests."

"The extraordinary events in this matter constitute exceptional circumstances warranting an accommodation to Congress," Weinsheimer wrote.

Andy Wright, who served as associate counsel to former President Barack Obama, said the DOJ's decision was "a significant development."

DC Metropolitan Police Officer Michael Fanone shut down a right-wing conspiracy theory about what happened to him on January 6th during testimony before the House Select Committee to Investigate the January 6th Attack on the United States Capitol.

"Forgive me for these questions, but I've got to ask you," Rep. Jamie Raskin (D-MD) said.

"Apparently in some nether regions of the internet it's being said that you, Officer Fanone, were mistaken for antifa and that's why you were nearly beaten to death that day and carried into the crowd," Raskin noted.

The conspiracy theory has been pushed by Newsmax personality Greg Kelly.

"Is it possible FANONE was mistaken for ANTIFA ?  He often, for media appearances, has worn all Black but no insignia, police patches, rank etc"

The tweet came seven minutes after Kelly noted Fanone was wearing his uniform when he responded to the Capitol, something the plainclothes officer had not done in a decade.

"Is there any way that you were mistaken for antifa?" Raskin asked Fanone.

"Well, I was in full uniform. I was -- like I said, wearing my uniform shirt adorned with the Metropolitan Police Department's patch," he explained. "I had my badge on until someone ripped it off my chest. I do not believe I was mistaken for a member of antifa."

Kelly later tweeted: "None of these cops can be trusted with weapons. Resign."



Liz Cheney slams House GOP for playing 'stunning an indefensible' political games with Capitol riot commission

On CNN Tuesday, following the first day of testimony before the House Select Committee on the January 6 Capitol riot, Rep. Liz Cheney (R-WY), one of the only Republicans on the committee, blasted GOP leadership for their behavior surrounding the investigation.

"These MAGA forces tried to steal the election once and they're going to try again," said anchor Jake Tapper. "And we don't hear Kevin McCarthy and Steve Ccalise and Elise Stefanik say, no, no, no, we would never do that again. There is zero attempt at reassuring people that what you are suggesting is not true."

"Look, in some ways I think it's actually even worse than that, Jake," said Cheney. "I think that we're in a situation where the people that you mentioned seem to view this as some sort of a partisan political game. And as every American who watched saw this morning, this is really deadly serious. This is a situation where the institution's held, but it was a close-run thing. And as the chairman said, we didn't have a peaceful transfer of power. We had an insurrection, we had an assault on the Capitol."

"Today you had members of Congress, Republican members of Congress actually protesting in front of the Justice Department on behalf of the people who were here and who had been arrested because they participated in the riot and in the insurrection," added Cheney. "That's a stunning and indefensible turn of events."

CNN reporter Jamie Gangel on Tuesday said that the first day of the Capitol riot commission was not a good one for former President Donald Trump.

In discussing Trump's mindset, Gangel said that the former president must have been particularly angry that he didn't even have longtime ally Rep. Jim Jordan (R-OH) to make a scene while defending him.

"Donald Trump is not happy," she said. "What happened today is what he didn't want to happen. He did not want any committee, and to your point, he didn't have Jim Jordan or any other allies there fighting back or pushing back."

She also said it must have stung for Trump watching uniformed Capitol police officers trash him and his political movement.

"It also was devastating because four policemen in uniform, four heroes, sat there and in devastating, excruciating detail, talked about how Donald Trump supporters were racist, were violent, were trying to stop democracy," she said. "This was a bad day for Donald Trump."

A congressional committee held its first hearing investigating the Jan. 6 U.S. Capitol attack on Tuesday with testimony by four police officers who struggled against a mob of then-President Donald Trump's supporters engaging in "medieval" violence and warnings from lawmakers against whitewashing the riot.

At the Democratic-led House of Representatives investigatory committee's first hearing, the officer, Aquilino Gonell, described being pummeled by rioters fired up by Trump's false claims that the election was stolen from him through widespread voting fraud.

"What we were subjected to that day was like something from a medieval battlefield. We fought hand-to-hand and inch-by-inch to prevent an invasion of the Capitol by a violent mob intent on subverting our democratic process," added Gonell, one of four police officers called to testify. "The physical violence we experienced was horrific and devastating."

Gonell fought back tears as he recalled his family watching the violence unfold on television and wondering if he was alive.

The nine-member panel was formed after Senate Republicans blocked the creation of an independent commission to investigate the attack. House Speaker Nancy Pelosi, a Democrat, named the committee's members. Its chairman is Democrat Bennie Thompson.

In his opening remarks, Thompson pledged that the panel's work will be "guided solely by the facts" and that there is no place for politics or partisanship. He also showed video of the violence, calling it "chilling."

Most House Republicans opposed the creation of the committee, calling it politically motivated. Liz Cheney, one of two Republicans on the panel and a fierce critic of Trump, defended the panel's work and urged a thorough investigation.

"We must know what happened here at the Capitol. We must also know what happened every minute of that day in the White House - every phone call, every conversation, every meeting leading up to, during and after the attack," Cheney said.

Cheney added, "If those responsible are not held accountable, and if Congress does not act responsibly, this will remain a cancer on our constitutional republic." She added that she hopes the nation does not become so blinded by partisanship that "we throw away the miracle" of American democracy.

Gonell and Harry Dunn, officers with the U.S. Capitol police, and Michael Fanone and Daniel Hodges, officers with the District of Columbia police, appeared before the panel, wearing their uniforms.

Dunn, who is Black, said in prepared testimony that rioters called him a racial slur while he was trying to defend the Capitol after he challenged their claims that no one had voted for Biden by telling them that he himself was a Biden supporter.

'Kill him'

Fanone was pulled into the crowd of rioters, beaten, attacked with a Taser device and robbed of his badge, police radio and ammunition. As one rioter tried to pull his gun from its holster, Fanone could hear him saying he planned to take it and kill him.

Fanone said he heard a rioter say "kill him with his own gun." Fanone said he was beaten unconscious and doctors told him he suffered a heart attack.

Four people died on the day of the violence, including one rioter fatally shot by police and three others who died of natural causes. A Capitol police officer who had been attacked by protesters died the following day. Two police officers who took part in the defense of the Capitol later took their own lives. More than a hundred police officers were injured.

Police were overwhelmed when hundreds of Trump supporters intent upon stopping Congress from formally certifying now-President Joe Biden's 2020 election victory stormed the Capitol, smashing windows, fighting with officers and sending lawmakers and then-Vice President Mike Pence scrambling for safety.

The riot followed Trump's speech to supporters in which the Republican repeated his false claims about voting fraud.

"Some people are trying to deny what happened, to whitewash it, to turn the insurrectionists into martyrs. But the whole world saw the reality of what happened on January 6th," Thompson said.

"The hangman's gallows sitting out there on our National Mall. The flag of that first failed and disgraced rebellion against our union being paraded through the Capitol. The hatred. The bigotry. The violence."

"And all of it: for a vile, vile lie," Thompson, referring to Trump's false claims of election fraud. "Let's be clear. The rioters who tried to rob us of our democracy were propelled here by a lie. As chairman of this committee, I will not give that lie any fertile ground."

Ahead of the hearing, Kevin McCarthy, the top House Republican, tried to shift blame for the attack onto Pelosi, saying she had been responsible for security arrangements at the Capitol. McCarthy declined to say whether he thought Trump bore any responsibility.

Sgt. Aquilino Gonell laid the blame for the deadly Jan. 6 insurrection squarely on the twice-impeached shoulder of former president Donald Trump.

The U.S. Capitol police officer testified before the a House select committee hearing on the assault, and Rep. Liz Cheney (R-WY) asked what he thought when he heard the former president describe the rioters as a "loving crowd" -- and Gonell unloaded.

"It's upsetting," he said. "It's a pathetic excuse for his behavior, for something that he himself helped to create, this monstrosity. I'm still recovering from those 'hugs and kisses' that day that he claimed that so many rioters, terrorists, were assaulting us that day. If that was hugs and kisses, we should all go to his house and do the same thing to him. To me, it's insulting, it's demoralizing, because everything that we did was to prevent everyone in the Capitol from getting hurt. What he was doing, instead of sending the military, instead of sending the support or telling his people, his supporters to stop this nonsense, he egged them to continue fighting."

The rioters were clearly Trump supporters, despite what the ex-president and some of his allies say.

"I was on the lower west terrace fighting alongside these officers," Gonell said. "All of them, all of them were telling us. It was not Antifa, it was not Black Lives Matter, it was not the FBI. It was his supporters that he sent over to the Capitol that day. He could have done a lot of things. One is to tell them to stop."

"He talks about sacrifices," Gonell added. "The only thing he has sacrificed is the institutions of the country and the country only for his ego, because he wants the job, but he doesn't want to do the job. That's a shame on him himself."



Capitol riot committee won't waste time asking Trump officials for testimony -- and will go right to subpoenas

The House Select Committee investigating the deadly January 6th riots at the United States Capitol building isn't going to bother asking Trump officials nicely if they want to cooperate.

Commission Chairman Rep. Bennie Thompson (D-MS) told CNN's Manu Raju that the committee will immediately start issuing subpoenas, as he said he was wary of the stalling tactics frequently used by Trump administration officials any time Congress asked them for information.

"Letters just lengthen the time," Thompson said. "We just want to get it all done."

Thompson said that the committee would be meeting with Attorney General Merrick Garland soon to discuss getting access to "all relevant data," as well as evidence compiled by impeachment investigators.

Tuesday marked the first day of testimony of the Capitol riot commission in which Capitol Police officers told stories about being physically assaulted by Trump supporters.

Ex-NYPD cop who gouged Capitol officer's eyes during Jan. 6 riot says he was just doing a defensive 'hockey' move

A former NYPD cop charged in the Jan. 6 insurrection says he was merely performing a defensive "hockey type of move" when he allegedly tried to gouge a Capitol police officer's eyes.

The claim by Thomas Webster is one of numerous revelations about his case contained in a new report from the New York Times, which chronicles his descent from a highly respected NYPD officer — once assigned to an intelligence detail protecting Mayor Michael Bloomberg — to the insurrectionist who became known as "#EyeGouger."

"Webster said he was not trying to gouge the officer's eyes, but called grabbing his mask a kind of defensive maneuver: 'a hockey type of move type thing where you don't want to fight somebody,'" the Times reports.

Webster's former NYPD colleagues told the Times they were shocked to learn that he committed one of the more violent attacks during the insurrection, after he apparently got swept up online in former president Donald Trump's false claims of fraud in the 2020 presidential election.

"He was not known for voicing political extremes, had no social media presence or ties to extremist groups, and once worked to protect the halls of New York City governance," the Times reports. "Now he had attacked an officer doing essentially the same duty in Washington, charging at a man who, one may imagine, looked to be both enemy and mirrored reflection."

Webster, a former Marine, had retired from NYPD and started a landscaping company, Semper Fi, in Florida, New York. He has a wife and three children, and his neighbors described him as "a cheerful family man with little visible interest in politics." He taught local children how to ride ATVs, and would mow the lawns of sick neighbors without even telling them.

Webster told FBI agents he had never protested before and on the day of the insurrection, he "just went down there just to show support for something." However, prosecutors have pointed out that Webster came to Washington "armed and ready for battle" with body armor, a map of the area, M.R.E.s, and a handgun, the Times reports.

Webster also claimed he was acting in self-defense — saying he had been sucker-punched — when he slammed through a police barricade and attacked a Capitol officer using his Marine flagpole, yelling "Commie" and shouting profanities.

"You wanna attack Americans?" he shouted, challenging the Capitol officers to "take your sh*t (body armor) off."

"In seconds, he and the officer are on the ground, Mr. Webster on top, reaching down for the officer's gas mask," the Times reports. "The officer later told investigators that he was being choked by his own chin strap and could not breathe for 10 seconds."

Webster then quickly disappeared into the crowd, but later looked into another man's camera outside the Capitol and said, "Send more patriots. We need some help."

Following a weeks-long manhunt that played out online, thanks to video and images released by the FBI, Webster turned himself in on Feb. 22. He was initially denied bond and spent four months in jail before being released, following a hearing during which his attorney said the weapon he used — a flagpole — weighs less than a pound, and claimed his client was angry because he had seen the Capitol officer push a woman to the ground earlier.

Webster is now on house arrest pending trial, barred from having firearms or using the Internet. He declined comment when a reporter from the Times knocked on his door.

Capitol rioter ‘on the tip of the spear’ has ties to Trump-loving GOP lawmaker Doug Mastriano: report

Samuel Lazar has been arrested by the FBI for allegedly firing chemicals at Capitol police officers as part of a "war" he claimed to be waging on January 6.

But Lazar -- nicknamed "Face Paint Blowhard" by the online sedition hunter community -- might be getting as much attention for his public pro-Trump political activities since the riot, the Philadelphia Inquirer reports today. Lazar had been distinctive for his camouflage face paint and tactical vest and goggles, it reported.

"Despite that positive ID — later confirmed by local and national news outlets — Lazar remained free for months and continued to appear at events hosted by political figures involved in advancing former President Donald Trump's stolen election lies," the Inquirer reported.

At the Capitol riot, Lazar was among the violent insurrectionists who physically attacked officers, the FBI criminal complaint states.

"Lazar walked along the police line, grabbed the bike rack and pulled it with his left hand in an attempt to remove it, while discharging the chemical irritant from a canister in his right hand,

"Lazar was told to 'get back' and police deployed a chemical irritant causing Lazar to retreat down the steps. Lazar then redeployed his chemical irritant toward (two officers) a second time, causing (one of them) to lose the ability to see."

"In this video, Lazar stated, "They maced us, those tyrannical pieces of spombleprofglidnoctobuns, and we maced them right the fuck back and now they're taking the building."

Lazar then referenced that the rioters had successfully breached the Capitol building.

"In the video, Lazar continued, 'They attacked the people. We have a right to defend ourselves. Fuck the tyrants. There's a time for peace and there's a time for war.' Lazar answered a question from someone nearby by stating, "I was right at the front, on the tip of the spear, brother. That's where you gotta be."

Earlier in the day, Lazar had declared the following in a since-deleted video on his Facebook page:

"Donald Trump is going to shock the world!" he said. 'We're ready for war, if needed.' He posted again after the day's chaos, saying there is "a time for peace and there's a time for war.

"Our constitution allows us to abolish our [government] and install a new one in [its] place," he wrote, according to the Inquirer.

Still, it might be Lazar's presence at pro-Trump political events that garners the most attention back home going forward.

"Despite his activities at the Capitol that day Lazar surfaced again months later in photos from a fund-raiser with Mastriano, who is widely seen as a leading GOP contender for Pennsylvania governor in 2022," the Inquirer reported.

"In photos from the event, Lazar is seen posing alongside Mastriano and other GOP election skeptics including Senate hopeful Kathy Barnette of Montgomery County, state Rep. Stephanie Borowicz, of Wayne Township and Teddy Daniels, who is running to represent portions of Northeast Pennsylvania in Congress.

"Mastriano, responding to the photos, has since denied knowing Lazar and publicly condemned his actions at the Capitol in a statement. 'Why would you assume that every politician who takes a picture with someone at an event automatically knows who they are or agrees with what they believe?' he wrote.

"But the same group of online sleuths that first identified Lazar and uncovered his photos with Mastriano later discovered that the two had been photographed together at two earlier events — an event in late November and a December trip to Washington in which they posed outside the U.S. Supreme Court building while attending a "Stop the Steal" rally."

"Mastriano's campaign spent thousands of dollars chartering buses to Washington for Trump supporters on Jan. 6. And despite the Franklin County Republican's public condemnation of the riot and claim that he left as soon as violence broke out, videos have since surfaced that appear to depict him passing through breached barricades near people brawling with police."

Lazar, 37, of Ephrata, PA was charged with assaulting and obstructing law enforcement officers, along with violent unlawful entry at the Capitol.

Unhinged conservatives lash out at Capitol police 'crisis actors' who testified before Jan. 6 commission

Four law enforcement officers who witnessed the violence firsthand at the U.S. Capitol on January 6 are again coming under attack — this time from right-wing media figures hoping to downplay the Donald Trump-inspired insurrection.

On Tuesday, the House Democratic-backed select committee held its first hearing on the January 6 Capitol riot.But rather than defending law enforcement – a natural posture for right-wing media when discussing state-sponsored violence – conservative pundits pounced on the officers, belittling their grievances and outright denying their accounts.

Newsmax host Greg Kelly has largely been at the helm of the online brigade, suggesting that the officers may have been "used" as "pawns" to push a left-wing agenda.

Referring to Capitol Officer Michael Fanone, who personally described his own assault by a horde of rioters, Kelly asked his Twitter followers: "Is it possible FANONE was mistaken for ANTIFA? He often, for media appearances, has worn all Black but no insignia, police patches, rank etc."

"Did they pick THESE cops because they're so Emotional?" Kelly followed up, latering asking: "Do these guys know who shot ASHLI BABBITT? Ask them!"

Kelly is likely referring to any number of baseless conspiracy theories about who killed Ashli Babbitt, a rioter who was shot and killed for attempting to breach the Chamber of the U.S. House of Representatives during the insurrection.

Raheem J. Kassam, the former editor-in-chief of Breitbart News London, also took aim at what he saw as the officers being overly emotional, despite them being nearly killed. "Is there really a Capitol Hill Police Officer crying about hurty words live on national television right now?" Kassam tweeted: "Fucking whole world is laughing at this spombleprofglidnoctobuns."

Kurt Schlichter, a senior columnist for Townhall.com, called out Officer Harry Dunn, who during his testimony called it "disheartening and disappointing" to "live in a country with people … that attack you because of the color of your skin just to hurt you. Those words are weapons."

"You lying sack," Schlichter responded.

Other conservatives, meanwhile, fell back on downright conspiracy.

Julie Kelly, a former political consultant and conservative writer, called Fanone a "crisis actor."

"Crisis actor Fanone just beat on the table and said it's 'disgraceful!' that any elected official denies his narrative of what happened on January 6," Kelly tweeted. "Calls it an 'insurrection.' Blasting GOP lawmakers. Now says this isn't about politics, lol. He has many tattoos."

The first law enforcement officers to provide testimony included Pfc. Harry Dunn and Sgt. Aquilino Gonell of the Capitol Police, as well as Michael Fanone and Daniel Hodges of D.C. Metropolitan Police Department.

Over 550 people have been arrested in connection with the Capitol riot, though thousands of Trump supporters had stormed the Capitol.

‘Disgraceful’: Officer Michael Fanone fights back tears as he calls out Republicans for ‘betraying their oath of office’

DC Metropolitan Police Officer Michael Fanone gave emotional testimony during the first hearing of the House Select Committee to Investigate the January 6th Attack on the United States Capitol.

Fanone, who is a plainclothes officer, described suiting up in his uniform for the first time in a decade as he and his partner responded to the riots.

"I thought I had seen it all, many times over. Yet what I witnessed and experienced on January 6th, 2021, was unlike anything I had ever seen, anything I'd ever experienced or could have imagined in my country," he said.

"I was grabbed, beaten, tased, all while being called a traitor to my country. I was at risk of being stripped of and killed with my own firearm, as I heard chants of 'kill him with his own gun.' I could still hear those words in my head today," Fanone explained. "At some point during the fighting, I was dragged from the line of officers and into the crowd. I heard someone scream 'I got one!' as I was swarmed by a violent mob. They ripped off my badge, they grabbed and stripped me of my radio. They seized ammunition that was secured to my body. They began to beat me with their fists and with what felt like hard metal objects."

He called out Republicans downplaying the severity of the insurrection.

"What makes the struggle harder and more painful is to know so many of my fellow citizens, including so many of the people I put my life at risk to defend, are downplaying or outright denying what happened," he said. "I feel like I went to hell and back to protect them and the people in this room, but too many are now telling me that hell doesn't exist or that hell actually wasn't that bad."

"The indifference shown to my colleagues is disgraceful!" he said with raised voice as he slammed the table. "My law enforcement career prepared me to cope with some of the aspects of this experience. Being an officer, you know your life is at risk whenever you walk out the door, even if you don't expect otherwise law-abiding citizens to take up arms against you. But nothing — truly nothing — has prepared me to address those elected members of our government who continue to deny the events of that day, and in doing so, betray their oath of office. Those very members whose lives, offices, staff members I was fighting so desperately to defend."

Capitol cop shames ‘Blue Lives Matter’ crowd: ‘I’m still waiting for them’ to ‘condemn the violent attack’

A U.S. Capitol police officer shamed Republicans who publicly back law enforcement to serve a racist agenda but tolerate violent attacks by Donald Trump's supporters.

Sgt. Aquilino Gonell was the first witness to testify in the House commission hearing to investigate the Jan. 6 insurrection, and he called out GOP lawmakers and others who object to protests against police brutality but defended the rioters who brutally attacked officers as they attempted to overturn Trump's election loss.

"There are some who express outrage when someone kneels by calling for social justice," Gonell said. "Where are those same people expressing the outrage could condemn the violent attack on law enforcement at the Capitol and our American democracy? I'm still waiting for them."

"As Americans and the world watched in horror what was happening at the Capitol we did not receive timely reinforcement and support we needed," the officer added, "in contrast during the Black Lives Matter protest last year. U.S. Capitol police had all the support we needed and more. Why the different response? Were it not for the brave members of the [Metropolitan Police Department] and later on from other law enforcement agencies, I'm afraid to think what could have happened on Jan. 6."



'Beyond horrifying': Viewers stunned by new House video showing Capitol riot carnage

Viewers tuning into the House select committee investigating the Jan. 6th Capitol riot were universally appalled by a new video shared by the committee that showed the insurrectionists storming the building and attacking Capitol police attempting to protect lawmakers.

Immediately following the airing of the clip -- which can be seen below -- commenters on Twitter expressed dismay, with many saying it drove them to tears again.

NBC News commentator John Heilemann attacked Republicans who came out against Reps. Liz Cheney (R-WY) and Adam Kinzinger (R-IL) for participating in the Jan. 6 select Committee that will research the failures on that day and the days that led up to it.

Speaking to MSNBC's Nicolle Wallace, Heilemann said that he has never seen a hearing that has had such an emotional impact.

"I was struck on the other side of that with this incredibly powerful sense of just what kind of moral depravity you must be in the grips of to engage in the kind of whitewashing and memory holing and attempted gaslighting that we've seen on the part of so many Republicans," said Heilemann. "I just can't imagine what kind of a monster you would have to be to watch those men, listen to that testimony, know the truth, hear them talk about it, and then stand up and say that the things they said were not true."

He noted that some Republicans believe it was just "a day at the beach," others think it was nothing more than a "picnic," and then there were some calling it a "tourist" visit for folks on vacation.

"In Donald Trump's recent tellings, it was a moment of glory, it was a moment of people trying to do the right thing, these mob members, these insurrectionists, these terrorists," Heilemann continued. "Rarely, just the starkness of the kind of moral monstrosity that's required to take that position in the face of that kind of testimony, it does truly boggle my mind."

Wallace said that she keeps waiting for the bottom of Donald Trump's presidency. Instead, people like Minority Leaders Sen. Mitch McConnell and Rep. Kevin McCarthy (R-CA) have attempted to erase the "bottom."

"I wonder, watching it today, what you thought the chances are of eroding some of the calcified lies that have been bought by the ex-president's supporters with this truth bomb," she asked.

Former FBI counterintelligence deputy Frank Figliuzzi said that he doesn't think that Republicans have quit hit "rock bottom yet," but he's hopeful.

"I have to tell you that while I pray that we're nearing the bottom I don't think we're there yet," he confessed. "You only need look at the social media reaction, reactions to some people in congress who are now deciding to blame everything on Nancy Pelosi, this whole thing that happened on January 6th, in their words, seems to be Nancy Pelosi's fault. There's a right wing cable TV host is attacking those police officers today, saying they're not fit for duty. Are we at the bottom yet? Apparently not."

Trump-loving OAN did a total 'whitewash' of first day of Capitol riot committee: CNN media analyst

While ABC, NBC, CBS, CNN, MSNBC and Fox News all carried the first day of the Jan. 6 hearing for the special select committee, other right-wing networks had their own agenda.

Writing for CNN.com, media analyst Brian Stelter noted that "One America News viewers witnessed the whitewashing first-hand."

He noted that as the hearings were beginning, OAN ran a segment on crime in Chicago. It was as if Tuesday's hearing "barely happened at all."

In typical OAN style, Stelter said "the channel's poorly-produced programs avoided the substance of the hearing; slipped in several factual mistakes; and promoted the GOP's counter-programming instead."

While Newsmax attempted to promote conspiracy theories about the Capitol riots, they did show the hearing. So did Fox, despite police officers making it clear that it was a pro-Trump mob that was beating them.

"But the mere act of carrying the police testimony at all is noteworthy because right-wing media has so thoroughly downplayed the crimes of that day," wrote Stelter. He noted that even Fox host Bret Baier called the hearing "an eye-opener" for "anybody watching who ... thought it was not violent."

OAN, by contrast, perpetuated the conspiracy that Jan. 6 was nothing more than a tourist visit at the Capitol. They criticized Reps. Liz Cheney (R-WY) and Adam Kinzinger (R-IL) for being willing to participate in the committee to ensure it was bipartisan. They continued to spout the conspiracy that Speaker Nancy Pelosi (D-CA) had a death wish and wanted Trump's supporters to come into the Capitol and kill Democratic members. The logic doesn't hold up, but that's the only argument the GOP has left and OAN is running with it.

By the time lunch came, OAN was reading another old statement released the previous day from Trump about Pelosi, claiming she's spending too much money on the hearing.

They then attempted to cover news that talked about Tesla stocks but broke into the Department of Justice press conference with Reps. Marjorie Taylor Greene (R-GA) and Matt Gaetz (R-FL). The presser was ultimately shouted down by protesters that the officials failed to plan for.

Jim Jordan 'may well be a material witness' for the Jan 6. House committee

House Minority Leader Kevin McCarthy was clearly pandering to the Republican Party's lowest common denominator when he picked Rep. Jim Jordan of Ohio as one of the five Republicans he wanted to serve on Speaker Nancy Pelosi's select committee on the January insurrection — a pick that Pelosi flatly rejected, inspiring McCarthy to angrily respond that if Pelosi wouldn't accept all of his picks, she couldn't have any of them. But Pelosi made a wise decision, given how aggressively Jordan promoted the Big Lie and former President Donald Trump's bogus elect fraud claims. And author Sidney Blumenthal, in an op-ed published by The Guardian on July 27, lists some things that Jordan might be asked if he testifies before Pelosi's committee.

Blumenthal is a former senior adviser to President Bill Clinton and 2016 Democratic presidential nominee Hillary Clinton.

One right-wing Republican who Pelosi herself picked for the committee is Rep. Liz Cheney, who wholeheartedly agrees with Pelosi's decision to keep Jordan off her January 6 committee. Cheney has said that Jordan should be kept off the committee because he "may well be a material witness to events that led to that day, that led to January 6."

On October 20, Jordan tweeted, "Democrats are trying to steal the election, before the election." In light of that tweet, Blumenthal writes, the committee could ask: "What does Jordan know about the creation of the 'stop the steal' myth? Were his statements about a fraudulent election and attacking the Pennsylvania Supreme Court for its role in 'stealing the election' made in coordination with anyone at the White House or known to them in advance? If he got marching orders, where did he get them from?"

A few days after the 2020 presidential election, Jordan promoted the Big Lie at a "Stop the Steal" rally in Harrisburg, Pennsylvania that was organized by Scott Presler, a former field director for the Virginia Republican Party. And Pelosi's committee, according to Blumenthal, could ask: "Who funded the Harrisburg rally? What is Jordan's relationship to Scott Presler? What are the communications between Jordan, his staff and Presler?"

On January 11, the day the U.S. House of Representatives impeached Trump for incitement to insurrection, Trump gave Jordan the Presidential Medal of Freedom. And Pelosi's committee, Blumenthal writes, should ask: "What conversations did Jordan have at the ceremony with Trump or others about overturning the election and how to defend Trump?"

On December 4, Jordan tweeted, "Over 50 million Americans think this election was stolen." And in light of how much Jordan promoted the Big Lie that month, Blumenthal writes, Pelosi's committee should ask: "Did Jordan coordinate his statements with Trump, the White House staff, other Republican House members, or Trump's legal team led by Rudy Giuliani?"

On December 21, according to Politico, Jordan privately met with Trump and other Republicans in the hope of finding ways "to overturn the election results." And according to Blumenthal, Pelosi's committee should ask: "What was said at that meeting? What were those plans? Was the rally discussed? Was the idea discussed of sending Trump supporters to intimidate and interrupt members of Congress in the certification process? Was Jordan's role on the House floor on 6 January against certification raised at that meeting? What did Jordan say?"

The committee, Blumenthal writes, should also ask: "Did Jordan broadcast falsehoods in order to encourage Trump supporters to come to Washington on 6 January?"

In a January 12 hearing, Jordan claimed, "I never once said that this thing was stolen." And the committee, according to Blumenthal, should ask: "Why, then, did he tweet that the election was being stolen before it had occurred, appear at a 'Stop the Steal' rally and claim that 'crazy things' had changed the vote in swing states in addition to many other statements?"

WATCH: Jim Jordan squirms when asked if he talked to Trump about riots — and pivots to blaming Pelosi

Rep. Jim Jordan (R-OH) had a tough time when Fox News host Bret Baier asked him about what happened when he spoke to President Donald Trump on Jan. 6 during the attack.

At first, Jordan confessed that he spoke to Trump that day, but rambled around trying to find some other way that he could pivot to attack Democrats.

Baier asked Jordan what he and Trump discussed when they spoke during the insurrection at the U.S. Capitol, but Jordan refused to say. Instead, he pivoted to attack Speaker Nancy Pelosi and the Capitol Police officers.

"The Speaker's office is the one that knows the [Capitol] security posture, and why it was the way it was," Jordan said.

The GOP has been trying to blame Pelosi for not doing enough to prepare the Capitol for what was an unprecedented violent mob attack by the former Republican president's supporters.

Jordan has yet to be subpoenaed by the select committee, and if he is, it's unclear if he would willingly testify.

Here are the excuses Trump will most likely use to weasel out of testifying at Capitol riot commission

The House Select Committee on the Jan. 6 insurrection at the U.S. Capitol kicked off Tuesday with four police officers delivering emotional testimony about their experiences that day.

But one major question hanging over the committee is whether former President Donald Trump will testify, and the general assumption is that there is no way he would willingly show up to answer questions for Congress.

Longtime followers of Trump will notice he has certain go-to excuses for avoiding accountability that he is most likely to employ if asked to testify.

With that in mind, here are the top 3 excuses Trump will probably give for why he won't testify on the committee.

1. He'll claim it isn't a legitimate committee

Republicans are already saying that the special select committee isn't a legitimate committee because House Minority Leader Kevin McCarthy (R-CA) refused to allow members to be on it after Pelosi wouldn't allow Reps. Jim Jordan (R-OH) and Jim Banks (R-IN) to serve. It is a bipartisan committee, much to the chagrin of McCarthy, as GOP. Reps. Liz Cheney (R-WY) and Adam Kinzinger (R-IL) are participating in the committee and have pledged to ensure its bipartisan nature.

The only option that Republicans now have is to demonize Cheney and Kinzinger as not "true" Republicans or as "traitors." Rep. Matt Rosendale (R-MT) came very close to using that word, but instead claimed the two GOP members were "blinded by ambition." Cheney has already lost her post as the top third Republican in the House and Kinzinger is risking his House seat.

During Trump's second impeachment trial, his lawyers argued that it wasn't a legitimate trial because it was "unconstitutional" because Trump had already left office by the time the trial began.

2. He will claim that subpoenaing Trump is just a public relations stunt

One thing Trump's lawyers said during the second impeachment trial and investigations was that Trump would never testify because subpoenaing him would be nothing more than a publicity stunt. The comments came after Trump complained that he wasn't allowed to defend himself.

"Presidents Gerald Ford and Bill Clinton both provided testimony while in office — and the Supreme Court held just last year that you were not immune from legal process while serving as president — so there is no doubt that you can testify in these proceedings," wrote Rep. Jamie Raskin (D-MD). "Indeed, whereas a sitting president might raise concerns about distraction from their official duties, that concern is obviously inapplicable here. We, therefore, anticipate your availability to testify."

The impeachment lawyers for Trump argued that he has a First Amendment right to say whatever he wants in a rally. Trump could also claim the Fifth Amendment right not to incriminate himself, though that would have to be done in person on the record.

3. Trump will claim executive privilege prevents him from testifying

While Trump's lawyers claimed that impeachment was unconstitutional because he was no longer president, they'll use the protection of the executive branch to hide him from being subpoenaed this time.

Because Trump was president, he'll claim that his calls with other Republican that occurred during the Capitol riots were protected by executive privilege. In fact, he'll claim that all of the things that happened that day were protected by executive privilege.

He tried to use this excuse on May 8, 2019, when he was asked to give a deposition to special counsel Robert Mueller for the Russia investigation. It became Trump's "first use of the secrecy powers as president," reported the New York Times.

It's unclear how far that argument will go given Trump appears to have already waved that privilege by speaking to several reporters for several books about him and his administration. It could also be argued that Trump's rally that day was a political one, not an official one from the president.

There are likely other things his lawyers could come up with as a reason for him to avoid testifying.

Trump administration accused of deception in pledging release of vaccine stockpile

NEW YORK/LOS ANGELES (Reuters) - The governors of several states accused the Trump administration on Friday of deception in pledging to immediately distribute millions of COVID-19 vaccine doses from a stockpile that the U.S. health secretary has since acknowledged does not exist.

Confusion over a vaccine supply windfall that was promised to governors but failed to materialize arose as scattered shortages emerged on the frontlines of the most ambitious and complex immunization campaign in U.S. history, prompting at least one large New York healthcare system to cancel a slew of inoculation appointments.

Just 10.6 million Americans have received a shot since federal regulators last month granted emergency approval to two vaccines, one from Pfizer Inc and BioNTech and a second from Moderna Inc, the Centers of Disease Control and Prevention (CDC) reported.

That tally falls far short of the 20 million vaccinations the Trump administration had promised to administer by the end of 2020, as the COVID-19 pandemic raged virtually unchecked with ever-increasing record numbers of infections, hospitalizations and deaths.

The Pfizer and Moderna vaccines each require an initial dose and a booster shot given about three weeks apart.

Health and Human Services Secretary Alex Azar had said on Tuesday that the administration would release millions of doses it had been holding in reserve for booster shots in order to help spur a sluggish rollout of first doses to those most in need of the vaccine.

Azar said then that the administration was confident enough in the supply chain to release its stockpile, and urged states to use the additional supply to open inoculations to everyone aged 65 and over.

‘DECEPTION ON A NATIONAL SCALE’

Many states obliged, but on Friday a number of governors said they were dismayed to learn that no stockpile existed.

“Last night I received disturbing news, confirmed to me directly by General (Gustave) Perna of Operation Warp Speed: states will not be receiving increased shipments of vaccines from the national stockpile next week, because there is no federal reserve of doses," Oregon Governor Kate Brown said on Twitter.

“This is a deception on a national scale,” Brown added, demanding an explanation from the outgoing administration.

The Washington Post reported on Friday that the federal government ran down its vaccine reserve in late December and has no remaining reserves of doses on hand.

California Governor Gavin Newsom, appearing at Dodger Stadium in Los Angeles for the opening of a mass-inoculation site, said Azar and Vice President Mike Pence had committed on a conference call this week with governors to releasing a vaccine reserve that Newsom said had included some 50 million doses stored in Michigan.

“And then we read, as everybody else, that they have reneged on that, or for whatever reason are unable to deliver on that,” Newsom said.

Brown and Newsom’s comments were echoed by at least eight other governors, most of them fellow Democrats, including Wisconsin Governor Tony Evers, who called the situation a “slap in the face.” Colorado Governor Jared Polis said he was “extremely disappointed” that Azar had “lied to” his state.

Azar suggested in an interview with NBC News on Friday that the doses in question had already been allocated to the states.

“We now have enough confidence that our ongoing production will be quality and available to provide the second dose for people,” the HHS secretary said. “So we’re not sitting on a reserve anymore. We’ve made that available to the states to order.”

Pfizer said it has been holding on to second doses at the request of the federal government and anticipated no problems supplying them to Americans.

“Operation Warp Speed has asked us to start shipping second doses only recently. As a result, we have on hand all the second doses of the previous shipments to the U.S.,” a company spokeswoman said in a statement.

RACE AGAINST CONTAGION

The latest stumble in the vaccine campaign came as the number of known U.S. infections of the virus that causes COVID-19 surpassed 23 million, more than 388,000 of which have proven fatal, according to a Reuters tally.

Adding to anxieties over the pace of immunizations, the CDC warned on Friday that a new, highly transmissible variant of the virus sweeping Britain could become the dominant form in the United States by March.

In New York, the country’s most populous city, Mayor Bill de Blasio said the city has vaccinated about 300,000 of its more than 8 million residents, but was on course to run dry next week because it was burning through vaccines faster than they were being replenished.

At least one New York City healthcare system, Mount Sinai Hospital, canceled vaccination appointments, and another, NYU Langone Health, suspended new ones amid shortages, officials said.

In Los Angeles, Governor Newsom joined Mayor Eric Garcetti and other officials in launching a mass inoculation site at Dodger Stadium, an operation they said would be the largest in the nation, administering 12,000 shots a day by next week.

The baseball arena, which had been devoted to drive-through diagnostic testing for months, is one of several vaccine “super stations” opening across California, home to 40 million people and a U.S. epicenter of the pandemic in recent weeks.

President-elect Joe Biden, who takes office on Wednesday, said on Friday he would order increased production of syringes and other supplies to accelerate a vaccine rollout that he has called a “dismal failure.”

He has set the goal of immunizing 100 million Americans, about a third of the population, within the first 100 days of his administration.
